HomeGuard Insurance Hub is a lead generation and referral service ONLY. We are NOT an insurance company, insurance agency, or insurance broker. We do NOT provide insurance quotes, sell insurance policies, or provide insurance advice.

Our Service connects homeowners seeking insurance information with licensed insurance companies and agents who may contact you with quotes and information. All insurance decisions, underwriting, and policy issuance are made solely by the insurance providers.

4. User Consent to Contact & TCPA Compliance

EXPRESS WRITTEN CONSENT:

By submitting your contact information through our Service, you provide your express written consent to receive marketing and promotional telephone calls, text messages (SMS/MMS), and emails from us and our insurance partners, including:

  • Calls and texts using automated telephone dialing systems (ATDS)
  • Artificial or pre-recorded voice messages
  • Contact even if your number is on any Do Not Call registry
  • Contact from multiple insurance providers and agents

You understand that your consent is not a condition of purchasing any goods or services. Message and data rates may apply for text messages. You may revoke this consent by contacting us, but such revocation will not affect communications already initiated or consented to with third-party partners.

5. Information Sharing

By submitting information through our Service, you explicitly authorize and direct us to:

  • Share your personal information with multiple insurance providers and agents
  • Store and process your information as described in our Privacy Policy
  • Use your information to match you with appropriate insurance partners
  • Contact you regarding your request and related insurance products

Once shared, insurance partners are responsible for their own use of your information according to their privacy policies.

6. No Guarantee of Services or Results

We make NO guarantee, representation, or warranty that:

  • You will receive any insurance quotes or callbacks from partners
  • You will qualify for insurance coverage
  • Any specific rates, terms, or coverage will be available
  • Our partners will respond within any particular timeframe
  • The Service will meet your expectations or requirements

Insurance providers make independent decisions about who to contact and what coverage to offer based on their own underwriting criteria.

7. User Obligations & Prohibited Conduct

You agree NOT to:

  • Provide false, inaccurate, or misleading information
  • Use the Service for any unlawful purpose or illegal activity
  • Submit multiple fraudulent or spam requests
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated systems or software to extract data (scraping)

8. Intellectual Property Rights

10. Disclaimer of Warranties

AS-IS BASIS:

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. We make no warranties about the accuracy, reliability, or completeness of any content or information provided through the Service.

11. Limitation of Liability

MAXIMUM LIABILITY:

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEGUARD INSURANCE HUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICE OR FROM ANY COMMUNICATIONS, INTERACTIONS, OR MEETINGS WITH INSURANCE PROVIDERS OR OTHER USERS.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED FIFTY DOLLARS ($50.00) OR THE AMOUNT YOU PAID US IN THE LAST SIX MONTHS, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless HomeGuard Insurance Hub, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

  • Your violation of these Terms of Use
  • Your use or misuse of the Service
  • Your breach of any representation or warranty herein
  • Your violation of any third-party rights
  • Any information you submit through the Service

13. Arbitration & Dispute Resolution

BINDING ARBITRATION:

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, which are available at www.adr.org. The arbitrator’s decision is final and binding and may be entered as a judgment in any court of competent jurisdiction.

CLASS ACTION WAIVER: YOU AND HOMEGUARD INSURANCE HUB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which HomeGuard Insurance Hub operates, without regard to its conflict of law provisions.

To the extent arbitration does not apply, you agree to submit to the personal jurisdiction of the state and federal courts located in our jurisdiction.

15. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect.

By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HomeGuard Insurance Hub regarding the Service and supersede all prior agreements and understandings, whether written or oral.
